The scope of the Minnesota Wetland Conservation Act (WCA) includes the regulation of the permanently and semi-permanently flooded areas of Type 3, 4, and 5 wetlands, and in all wetland types if the excavation results in filling, draining, or conversion to non-wetland.
Prior to excavating within a wetland, please contact your LGU to determine if the wetland excavation is regulated by WCA. Other jurisdictions, including the U.S. Army Corps of Engineers, may also have regulatory authority over wetland excavation projects.
The following excavation activities are regulated by WCA, regardless of wetland type.
Draining: Wetland excavations that drain wetland areas.
Filling: Wetland excavations that place fill or deposit spoil within a wetland area, even temporarily.
Conversion to non-wetland: Wetland excavations that exceed 2 meters of typical water depth.
